To prove Robbery the State must show 1) a taking of property 2) through the use of force or threatened force. Robbery is considered a crime of violence or what is often referred to as a “person crime.” Because of this, the likelihood of a prison sentence is higher. It is also common for such cases to have companion charges to include assault, unlawful use of a weapon, menacing, coercion, etc.
Oregon law recognizes different degrees of Robbery. Sentences can range from probation to up to 20 years in prison. Punishment varies depending on the type of force used or threatened, the harm to the victim, and other factors.
As with Burglary, Oregon case law regarding Robbery is fairly complex. Hiring experienced, dedicated defense counsel is your best protection against wrongful conviction or excessive sentencing.
