In order to convict someone of Computer Crime—Fraud or Theft, the state must prove each of the following elements beyond a reasonable doubt:
The act occurred on or about the alleged date.
The defendant knowingly accessed, attempted to access, used, or attempted to use a computer, computer system, computer network, or any part thereof.
The purpose of the defendant's actions was to devise or execute a scheme or artifice to defraud, or;
The purpose also includes obtaining money, property, or services by means of false or fraudulent pretenses, representations, or promises, or:
The purpose was committing theft or committing theft of proprietary information.
Computer Crime—Alteration, Damage, or Destruction
In order to convict someone of Computer Crime—Alteration, Damage, or Destruction, the state must prove each of the following elements beyond a reasonable doubt:
The act occurred on or about the alleged date.
The defendant knowingly and without authorization:
Altered, damaged, or destroyed any computer,
Altered, damaged, or destroyed any computer system,
Altered, damaged, or destroyed any computer network,
Altered, damaged, or destroyed computer software contained in a computer, computer system, or computer network,
Altered, damaged, or destroyed computer program contained in a computer, computer system, or computer network,
Altered, damaged, or destroyed documentation contained in a computer, computer system, or computer network, or
Altered, damaged, or destroyed data contained in a computer, computer system, or computer network.
Computer Crime—Unauthorized Use
In order to convict someone of Computer Crime—Unauthorized Use, the state must prove each of the following elements beyond a reasonable doubt:
Timing: The act occurred on or about the alleged date.
The defendant knowingly and without authorization did one or more of the following:
Used any computer, computer system, computer network, computer software contained in a computer, computer system, or computer network, or,
Accessed any computer, computer system, computer network, computer software contained in a computer, computer system, or computer network, or,
Attempted to access any computer, computer system, computer network, computer software contained in a computer, computer system, or computer network, or,
Used or accessed any computer program contained in a computer, computer system, or computer network, or,
Used or accessed documentation contained in a computer, computer system, or computer network, or,
Used or accessed data contained in a computer, computer system, or computer network.
